  11 1. OCTROI DE LICENCE - Le Gouvernement du Canada (Environnement et Changement
  12 climatique Canada) est le détenteur de tous les droits de propriété
  13 intellectuelle (y compris les droits d’auteur) associés au produit logiciel et
  14 aux données. Par les présentes, Environnement et Changement climatique Canada
  15 vous accorde une licence restreinte, non exclusive et incessible vous permettant
  16 d’utiliser le produit logiciel et les données, sous réserve des conditions
  17 décrites ci-dessous. Le titre de propriété et tous les droits de propriété
  18 associés au produit logiciel et aux données sont et doivent demeurer propres à
  19 Environnement et Changement climatique Canada. Le produit logiciel et les
  20 données peuvent seulement être utilisés par vous; et vous ne pouvez pas louer,
  21 céder, prêter, accorder de sous-licences ni transférer à quiconque le produit
  22 logiciel et/ou les données ou tout droit associé, et ce conformément aux

  28 rais ne seront facturés expressément pour le produit logiciel et/ou les données
  29 distribués à une tierce partie, mais vous pouvez toutefois facturer des services
  30 à valeur ajoutée. En considération de la licence qui vous est octroyée, il vous
  31 incombe de reconnaître la source du produit logiciel et/ou des données en
  32 indiquant la mention suivante ou quelque chose de similaire : créé à partir de
  33 données d’Environnement et Changement climatique Canada. La redistribution de
  34 produit logiciel et/ou des données à toute tierce partie est autorisée seulement
  35 lorsque cette tierce partie à été informée par vous des conditions générales
  36 d’utilisation du produit logiciel et des données sources et que cette tierce
  37 partie accepte lesdites conditions d’utilisation.

  88 LIMITED USE SOFTWARE AND DATA PRODUCT LICENCE AGREEMENT

  90 1. GRANT OF LICENCE - The Government of Canada (Environment and Climate Change
  91 Canada) is the owner of all intellectual property rights (including copyright)
  92 of this Software and Data Product. You are granted a limited, non-exclusive,
  93 non-assignable and non-transferable licence to use this software and data
  94 product subject to the terms below. This licence is not a sale of any or all of
  95 the owner's rights. This product may only be used by you, and you may not rent,
  96 lease, lend, sub-licence or transfer the data product or any of your rights
  97 under this agreement to anyone else, except under the following terms and
  98 conditions.

 100 2. REDISTRIBUTION RESTRICTIONS - You are authorized to further distribute the
 101 data or software, including any portion of it, contained in this product under
 102 the following conditions only. No fee will be charged explicitly for this
 103 Environment and Climate Change Canada product to any party to whom it is
 104 distributed. (Charges for value-added services are permitted.). In consideration
 105 f the licence you are herein granted, you have the obligation to acknowledge the
 106 source of the Environment and Climate Change Canada Data with the following
 107 layout or something similar: based on Environment and Climate Change Canada
 108 data. Redistribution must occur so that any other party must agree to the same
 109 redistribution restrictions before use of the redistributed product is allowed.

 111 3. NO WARRANTIES - Environment and Climate Change Canada does not warrant the
 112 quality, accuracy, or completeness of any information or data. Such information
 113 and data is provided "AS IS" without warranty or condition of any nature.
 114 Environment and Climate Change Canada disclaims all other warranties, expressed
 115 or implied, including but not limited to implied warranties of merchantability
 116 and fitness for a particular purpose, with respect to the software, the data
 117 retrieved from this product, and any accompanying materials.

 119 4. RESTRICTION AND LIMITATION OF LIABILITY - In no event shall Environment and
 120 Climate Change Canada be liable for any other damages whatsoever (including,
 121 without limitation, damages for loss of business profits, business interruption,
 122 loss of business information, or other pecuniary loss) arising out of the use
 123 of, or inability to use this Environment and Climate Change Canada product, even
 124 if Environment and Climate Change Canada has been advised of the possibility of
 125 such damages. In any case, Environment and Climate Change Canada's entire
 126 liability under any provision of this agreement shall be limited to the amount
 127 actually paid by you for the data product.

 129 5. RESPONSIBLE USE - It is YOUR RESPONSIBILITY to ensure that your use of this
 130 product complies with these terms and to seek prior written permission from
 131 Environment and Climate Change Canada and pay any additional fees or royalties,
 132 as may be required, for any uses not permitted or not specified in this
 133 agreement.

 135 6. ACCEPTANCE OF THIS AGREEMENT - Any use whatsoever of this Software and Data
 136 Product shall constitute your acceptance of the terms of this agreement.
